Warranty Extension - SatCare Additional Assistance
SatCare Additional Assistance does not affect the rights recognized to the consumer by Legislative Decree 206/2005
SUBJECT AND REQUIREMENTS FOR SATCARE ADDITIONAL ASSISTANCE
Intermatica S.p.A. undertakes to repair free of charge any defect or failure that may involve the product indicated on the warranty extension certificate (hereinafter "SatCare certificate") through its authorized service centers during the period of validity of the certificate.
Intermatica S.p.A. undertakes to restore, without charge, the conformity of the goods by repairing or replacing the same or one of its components that is found to be flawed. The asset can be replaced or repaired, free of charge in both cases. Although there is no right in this regard, Intermatica reserves the right to replace it with another of the same or more current model of equal quality, yield and efficiency in the event of replacement of the non-conforming good.
To request SatCare Additional Assistance, the Customer must contact Intermatica Customer Service on 06 85365 or write an e-mail to ConTe@intermatica.it.
In the event that the authorized service centers do not detect the defect or failure, the Customer will be required to bear the costs related to the intervention unless the Customer is able to demonstrate that, taking into account the circumstances, it was not possible to detect the absence of defects or breakdowns.
SatCare Additional Assistance is valid for the product shown on the certificate and cannot be transferred to other goods.
SatCare Additional Assistance must be signed within 2 years from the purchase of the product.
It will be the Customer's responsibility to prove to Intermatica the purchase of the goods by sending the tax receipt or equivalent document which indicates the name of the seller, the date of purchase as well as the relative identification references of the product.
The services relating to the warranty extension can only be rendered following the presentation of the SatCare certificate (this document will be sent by Intermatica to the Customer via e-mail following verification of the successful outcome of the purchase).
The intervention of the authorized assistance center, the collection and delivery of the product, its repairs and its possible replacement will be carried out, within time limits compatible with the organizational needs of Intermatica, by authorized and competent technicians, upon customer request and without causing significant inconvenience to the same.
The interventions, the collection and delivery of the product, its repairs and replacements, if covered by the warranty extension, will take place without any burden for the Customer.
SatCare Additional Assistance provides the Customer with a replacement product ("Courtesy Telephone") during the repair period only upon reservation by the latter and subject to availability. Through the Courtesy Telephone, Intermatica S.p.A. only guarantees coverage of the voice service.

DURATION, TRANSFERABILITY AND WITHDRAWAL RIGHT OF SATCARE ADDITIONAL ASSISTANCE
The Additional Assistance service has a duration of 3 years starting from the expiry date of the conventional guarantee. The Supplementary Assistance will automatically cease at the end of the 3 years without the need for any notification.
The repair or replacement of the product does not renew or extend the duration of the validity of the Additional Assistance.
If the product is replaced during the duration of the Additional Assistance, the certificate originally issued will lose its validity. The remainder of the term will be transferred to the new product following the issue of a new certificate.
If the product is sold or sold, the certificate can be transferred to the new owner. In this case Intermatica must be informed of the change by sending a communication to ConTe@intermatica.it. These supplementary assistance conditions will remain valid and will be transferred at no cost to the new owner. In any case, this will not entail a renewal or an extension of the duration.
The Customer has the right to withdraw from the Supplementary Assistance contract within 14 days from the date of purchase, without any penalty and obligation to mention the reason. To exercise the right of withdrawal, it is sufficient to send a written communication, by registered letter, to Intermatica SpA Customer Service, Via Gaetano Donizetti, 7 - 00198 Rome (for the respect of the terms, the date of dispatch of the communication of the withdrawal will prevail), or by email at ConTe@intermatica.it Intermatica will refund the amount paid within 14 days from the day of notification of the Customer's decision to exercise the right of withdrawal by crediting.
The following are not covered by SatCare Additional Assistance:
- product defects resulting from normal wear and tear, abnormal or improper use and / or if the user manuals have not been followed (e.g. oxidation);
- product defects deriving from accidental events (e.g. fall) or in any case maliciously caused to the product itself;
- defects deriving from repairs carried out in a manner or in unauthorized centers (opening the device has the same value as the intervention of an unauthorized third party);
- any damages, and malfunctions due to neglect, negligence, or tampering with the product;
- use of non-original accessories and spare parts;
SatCare Supplementary Assistance does not include additional compensation rights for any damage suffered. Intermatica S.p.A. in no case is liable for the interruption of operation, for the loss of earnings and for the loss of data or other information. The safety of these is the sole responsibility of the customer.
DISCLOSURE EX ART. 13 EU REGULATION 2016/679
Pursuant to art. 13 of EU Regulation 2016/679 ("GDPR"), we inform you that the data entered in the application form will be processed by Intermatica SpA, with registered office in Via Montello, 30 - 00195 Rome, as Data Controller, exclusively for provide the Additional Assistance service.
The provision of data is essential to guarantee the aforementioned service and, therefore, it is not necessary to collect the buyer's consent. The aforementioned data will not be disclosed and will be processed by Intermatica employees and collaborators, appointed as data processors, and may be disclosed to other third parties that provide ancillary services such as, for example, companies of the Intermatica Group, appointed external data processors. Only if the Customer agrees, the data will be used for (a) the sending of promotional communications relating to Intermatica products and services. Even if you decide not to consent (ie by checking the "I do not agree" box), there will be no consequences on the operation of the Additional Assistance. Technical and organizational measures will be used to protect data, for example, from manipulation, loss and unauthorized access by third parties. Security measures are continuously reviewed and improved hand in hand with technological progress. The data will not be disclosed outside the EU. The data will be stored in paper and electronic format, for the period necessary to achieve the purposes indicated above. The retention periods are identified, taking into account the legal, contractual and any other useful elements. We inform you of the existence of the right of access to personal data, of rectification, of cancellation "right to be forgotten", of limitation of treatment, of data portability and of opposition to the processing of personal data concerning you, at any time.
We also inform you that you have the right to withdraw consent to the processing of your data at any time, without prejudice to the lawfulness of the treatment based on the consent given before the revocation (art.7, paragraph 3, of the GDPR).
Pursuant to art. 77 of the Regulation, you are recognized the right to lodge a complaint with a supervisory authority, in particular in the Member State in which you habitually reside, work or in the place where the alleged violation occurred.

APPLICABLE LAW AND COMPETENT COURT
These General Conditions are governed by Italian law. For any dispute that may arise from the interpretation or application of the same, the Court of the place of residence or residence of the consumer will be exclusively competent.
This Guarantee is insured by Intermatica S.p.A., Via G. Donizetti n. 7, 00198 - Rome.
