Intermatica Terms of Sale

1. General provisions

These general terms and conditions of sale (hereinafter, "General Conditions") govern the sale and / or supply of goods and / or services (hereinafter, "Products" or "Product") by Intermatica S.p.A. (hereinafter "Intermatica") to the Customer and apply to all sales of products purchased through the website www.intermatica-shop.it (hereinafter, the "Site").

The website www.intermatica-shop.it is owned by Intermatica S.p.A. with registered office in Via Montello, 30 -00195- Rome (VAT number 05389281006, registration in the Companies Register of Rome no. 38405), and is aimed at the sale of products and / or online services.

The contracts concluded with Intermatica through the Site are governed by Italian law and, in particular, by the Legislative Decree 6 September 2005, n. 206 ("Consumer Code") and by Legislative Decree 9 April 2003, n. 70 (hereinafter, "E commerce decree").

 

2. Acceptance of the general terms and conditions of sale

By placing an order in the manner provided on the Site, the Customer declares to have read all the information provided during the purchase procedure and to fully accept these general terms and conditions of sale. The general terms and conditions of sale are an integral part of the sales contract concluded between the customer and Intermatica. Therefore Intermatica invites you to carefully read these, to print them or in any case to keep a copy.

 

3. Product information

The information relating to products that can be sold remotely through the Site is available, with the relative product codes, on the Site.

The products will be supplied in compliance with what described in the relative brochures and technical sheets.

The aforementioned information is provided in accordance with articles 52 and 53 of the Consumer Code.

Intermatica, as a service provider, emphasizes that the brochures and data sheets are drawn up with reference to the characteristics provided by the supplier / manufacturer; therefore Intermatica ensures every effort to ensure the accuracy of the description of the technical data and any other documentation relating to the goods, but declines any responsibility for any damage deriving directly or indirectly from any error or omission present in the documents described above.

Intermatica is not responsible for any technical and / or commercial changes to the products promoted and decided by the manufacturer of the goods.

 

4. Product changes

Intermatica reserves the right to make changes to the products or their specifications without prior approval or notification to the Customer for:

     (a) changes that do not adversely affect product performance;

     (b) changes necessary for security purposes;

     (c) changes needed to meet product specifications;

     (d) changes necessary to comply with applicable legal or regulatory requirements.

Intermatica reserves the right to provide products with improvements without any obligation or responsibility to make the same changes in previously purchased products. Intermatica also reserves the right to change the prices and availability of models according to market conditions, the availability of components, and other business considerations.

 

5. Prices

The prices of the products expressed in the catalog are excluding VAT and net of all other taxes or duties. All prices are expressed in Euros.

The customer not resident in Italy is responsible for the payment of all taxes, duties, taxes, and other charges including the interests and penalties that are or can be paid by any non-Italian governmental entity regarding the sale and the import of goods, the provision of services and with regard to the transactions covered by this agreement. The unit prices apply only to the specified quantities and for the express delivery times.

Any change in quantity, product specifications and / or delivery date may require a revision of the unit price. Intermatica reserves the right to change product prices without notice. The prices indicated remain valid if an order is received before the expiration of an existing quote at the time of the price change. Subsequent orders for the same equipment may be subject to revised prices.

Before delivery, Intermatica reserves the right to make replacements, modifications and improvements to the products ordered, provided that such replacements, modifications or improvements do not affect the characteristics of the product originally agreed with the Customer.

 

6. Order of products

The essential characteristics and prices of the Products are shown in the offer for each Product.

In order to make purchases, the customer must be registered on the site.

The Customer must put the Product in the appropriate "cart", and when the purchase is made, he must select the desired delivery and payment method and continue sending the order.

By sending the order, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions related to the specific products, as well as these general terms and conditions of sale.

The customer will have the opportunity to view and follow the status of his order through the "Orders" area of ​​his account.

Intermatica reserves the right to evaluate the acceptance of orders received.

Intermatica's acceptance of the order is confirmed by sending a confirmation e-mail to the e-mail address communicated by the Customer when registering on the Site.

The Customer undertakes to verify the correctness of the data in the order confirmation email and to promptly report any errors or omissions to Intermatica.

 

7. Methods of payments

All payments, from national or international customers, will be made in Euro currency.

Intermatica accepts payments made in the following ways:

Immediate payment with Paypal account or advance bank transfer.

 

8. Ineffectiveness of the order

No contract must be considered concluded between Intermatica and the Customer if Intermatica has reasonable grounds to believe that the Customer does not operate on the basis of an effective and genuine interest in the purchase of the products ordered, or exercises the right of withdrawal in an abusive manner. In such cases, the order sent by the Customer must be considered as having no effect. Intermatica will send to the Customer, by e-mail, a communication certifying the non-conclusion of the Contract, taking care of the yes of the cancellation of any charge and / or expense charged to the Customer.

 

9. Complaints

Any complaints relating to product deliveries and their characteristics at the time of delivery must be reported to Intermatica in one of the following ways:

  • By contacting Customer Service on +39 06 85365;
  • By sending a registered A / R addressed to: Intermatica S.p.A. Via Gaetano Donizetti, 7 - 00198 Rome;
  • By sending a fax to +39 06 85304593.

Any external damage or the mismatch in the number of packages must be immediately reported to the Courier and also reported to Intermatica within 8 days through the means of communication listed above.

Any non-apparent damages found after the delivery of the Products must be reported to Intermatica within 8 days of their discovery.

In case of late delivery, complaints can be forwarded within 6 days of non-receipt with respect to the day scheduled for delivery or, if the product has been delivered, from the day of delivery.

Complaints must contain a description of their object and the reasons on which they are based.

 

10. Transport and delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer. In any case, the customer has the right to request the delivery of the products to a natural person of his choice. Upon delivery, the signature of an adult over the age of 18 will be required. No deliveries will be made to PO boxes.

For each order placed on the Site, Intermatica issues the transport document (delivery note) of the goods shipped, as well as attaching it via email, and issues electronic invoicing. For the issuance of the invoice, the information provided by the Customer at the time of the order is authentic. No change in the invoice will be possible after it has been issued.

Delivery costs are charged to the customer and are clearly indicated on the website and in the order form. Their value depends on the total import of the single order.

All purchases will be delivered by courier, with Standard service and without delivery notice, from Monday to Friday, excluding holidays and national holidays. Intermatica is not responsible for unpredictable delays.

Intermatica will update the order status on its website, including the shipment status.

For the delivery of the goods, the presence of the customer or his representative is required at the address of the recipient indicated in the order. Upon delivery of the goods by the courier, the customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the package is intact or unaltered. Any damage to the package and / or the Products or the mismatch in the number of packages must be immediately contested by means of a written control reservation on the proof of delivery of the Courier.

If the Customer is unavailable at the time of delivery, he can contact the courier's office of the city of residence and agree for a subsequent delivery or collection at the courier's office.

Intermatica is not economically responsible for parcels left in stock at the courier.

If the courier delivers the package to Intermatica for failure to collect by the Customer, Intermatica will contact the Customer for a possible return and reserves the right to request a refund for any storage costs as well as for the shipping costs incurred (return to Intermatica) and for those to be endured (return to the customer).

In the event that the Customer does not intend to fulfill the payment of the costs faced by Intermatica or does not get in touch so that to agree, or following our email with a request for a refund for the costs incurred, he will not respond within a reasonable period of time of 7 (seven) days. , Intermatica will keep the goods not collected due to default by the customer.

 

11. Mistakes

The information relating to the Products provided on the Site is constantly updated.
However, the complete absence of errors cannot be guaranteed.

Intermatica reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also to change or update the information at any time without prior communication.

 

12. Right of withdrawal

L and sales of products via the Internet are governed by articles 45 to 67 of Legislative Decree 206/2005 (Consumer Code). This legislation provides the consumer with the right to withdraw from contracts or contractual proposals, guaranteeing him the right to return the purchased product and to obtain a refund of the expenses incurred. The right of withdrawal does not apply to sealed audiovisual products and IT software products opened by the consumer, nor to sealed goods that do not lend themselves to be returned for hygiene or health protection reasons that have been opened after delivery.

The Customer is responsible for the decrease in the value of the goods resulting from a manipulation other than that necessary to establish the nature, characteristics and functioning of the products, namely:

  • in the absence of the original packaging;
  • in the absence of integral elements of the product (accessories, cables, instruction manuals, etc);

The right of withdrawal is reserved exclusively to consumers (natural persons who purchase goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore it cannot be exercised by legal persons and by natural persons who act for purposes related to the activity possibly carried out.

The costs of returning the product are charged to the customer.

The customer has a period of 14 (fourteen) days to withdraw.
The withdrawal period ends after 14 (fourteen) days from receipt of the goods or, in the case of services, from the conclusion of the contract. Within this term, the customer must communicate to Intermatica the intention to withdraw from the contract in one of the following ways:

  • by sending a registered letter with acknowledgment of receipt or a telegram or fax, using the available form, or any other explicit communication of the decision to withdraw, to the following address / number: Intermatica S.p.A. Via Gaetano Donizetti, 7 - 00198 Rome, or by fax 06 85304593.

Within 3 (three) working days from the receipt of the notice of withdrawal, Intermatica will send the Customer, to the email address indicated in the order or in the request for withdrawal, confirmation of authorization to withdraw.
Within 14 (fourteen) working days upon receipt of this communication, the Customer will, at its own expense, send the carefully packaged product to the address indicated above. The deadline is considered respected if the Customer ships the product before the expiration of the period of 14 (fourteen) days.

Pursuant to article 56 of Legislative Decree 206/05, Intermatica will reimburse all payments within 14 (fourteen) days from the date on which it became aware of the exercise of the right of withdrawal by the Customer, including the delivery costs (with the exception of the additional costs deriving from the possible choice of a type of delivery other than the less expensive type of standard delivery offered by Intermatica); in any case, the Customer will not have to bear any costs as a consequence of this refund. Intermatica may withhold the refund until it has received the intact product or until the Customer has shown that he has sent the goods back, whichever occurs first.

For purchases made by bank transfer and by PayPal payment, Intermatica will proceed with the refund by bank transfer.

 

13. Warranty

Pursuant to Legislative Decree 206/2005 ("Consumer Code") all products for sale on the site http://www.intermatica-shop.it are covered by the Legal guarantee of 24 months.

Based on the 24-month Legal Guarantee, Intermatica is responsible towards the consumer (the natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity that may be carried out ) for lack of conformity not found at the time of purchase.

The lack of conformity exists when the product is not suitable for the use to which it must habitually serve, does not conform to the description or does not possess the qualities promised by the seller, does not offer the usual qualities and performances of a good of the same type, is not suitable the particular use desired by the consumer if brought to the attention of the seller at the time of purchase and accepted by the seller (art. 129 of the Consumer Code).

The lack of conformity that occurs within 24 months from the date of purchase of the goods must be reported within 2 months from the date of discovery of the defect.

Unless proven otherwise, it is assumed that the lack of conformity that occurs within 6 months of delivery of the goods already existed on that date. In case of lack of conformity, the consumer has the right to restore, without charge, the conformity of the goods by repair or replacement (art.130 of the Consumer Code). The consumer can ask the seller, at his option, to repair or replace the goods, without charge in both cases, unless the requested remedy is objectively impossible or excessively expensive compared to the other. Repairs or replacements must be made within a reasonable time from the request of the Consumer; the average time for returning the product to the consumer is 24 days. If Intermatica is unable to return the repaired product within the maximum period of 60 days, the consumer may request one of the alternative remedies (replacement, termination of the contract, price reduction).

Intermatica reserves the right to send the product for any repairs to the Technical Assistance Center authorized by the Manufacturer.

 

14. Applicable law

These General Conditions are governed by Italian law and must be interpreted in accordance with Italian laws.

16. Personal Data

The customer's personal data are processed by Intermatica in compliance with current legislation on the protection of personal data (Legislative Decree no. 196 of 30 June 2003), in accordance with the information made available to the customer and according to the consents from this last manifested. Intermatica will take care of the timely updating of the information notices at the Customer Service, and on its websites.
